Antitrust and Trade Regulation, Public Procurement Law

We have obtained the certification in the JUVE Handbook of Commercial Law Firms as having an “excellent reputation in antitrust law”. We possess comprehensive practice experience with the coordination of antitrust control proceedings before the German Federal Cartel Office (Bundeskartellamt), other national competition authorities and the EU Commission. When necessary, we work in close cooperation with renowned Antitrust Law firms from abroad. An additional focus of our work lies in providing legal support to companies in fines litigation due to Antitrust Law violations and abuse proceedings as well as with the drawing up of distribution agreements and systems. Our advisory services with the preparation of Competition Compliance Programs for the protection of companies as well as their management boards and management are increasingly gaining importance from the viewpoint of our clients.

In Public Procurement Law, we advise public sector clients (public law bodies and their associated companies) with the development and performance of award procedures above and below the EU threshold values. In this context, our expertise includes, in the VOB/A (contract procedure for building works) area, demanding PFI and PPP building construction projects. In the services area, in addition to many years of experience with the privatization of state duties (ex. waste disposal or sewage disposal), we also possess broad knowledge in the structuring and performance of bidding processes of companies which are acting as sector contractors. Bidders in awarding procedures obtain legal advice from us for successful participation, whether with a view to support with the process related to the call for tenders or within the framework of review procedures before public procurement review boards and Courts of Appeal.
